Types of Data Collected

Personal data collected includes first name, last name, place and date of birth, and tax identification code for the purposes of training record-keeping, as required by applicable regulations.

Additional personal data such as phone number, e-mail address, company name, and VAT/tax identification number may be provided by the user for the purposes of invoicing and accounting management, and to receive related communications.

The e-mail address may also be provided, on an optional basis, for the purpose of collecting data related to the quality of the service provided, in compliance with ISO 9001 and 21001 standards.

The user may optionally give consent, free of charge, without time limits, also pursuant to Arts. 10 and 320 of the Civil Code and Arts. 96 and 97 of Law no. 633 of 22 April 1941 (Copyright Law), to the publication and/or distribution in any form of their images on the website of the Company/Entity ICE & FIRE s.r.l., in print and/or through any other distribution medium, as well as authorise the storage of their photos and videos in the Company/Entity’s digital archives, acknowledging that the purpose of such publications is purely informational and, where applicable, promotional.

Methods and Place of Processing of Collected Data

Methods of Processing

The Data Controller adopts appropriate security measures to prevent unauthorised access, disclosure, modification, or destruction of Personal Data.

Processing is carried out using IT and/or telematic tools, with organisational methods and logics strictly related to the stated purposes. In addition to the Data Controller, in some cases, other parties involved in the operation of this Application may have access to the Data (administrative, commercial, marketing, legal staff, system administrators) or external parties (such as third-party technical service providers, postal couriers, hosting providers, IT companies, communication agencies) also appointed, where necessary, as Data Processors by the Data Controller. The updated list of Processors may always be requested from the Data Controller.

Legal Basis of Processing

The Data Controller processes Personal Data relating to the User where one of the following conditions applies:

the User has given consent for one or more specific purposes; Note: in some jurisdictions the Data Controller may be authorised to process Personal Data without the User’s consent or another of the legal bases specified below, until the User objects (“opt-out”) to such processing. This does not apply, however, where the processing of Personal Data is governed by European data protection legislation;
processing is necessary for the performance of a contract with the User and/or for the execution of pre-contractual measures;
processing is necessary to comply with a legal obligation to which the Data Controller is subject;
processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the Data Controller;
processing is necessary for the purposes of the legitimate interests pursued by the Data Controller or a third party.

It is always possible to ask the Data Controller to clarify the specific legal basis for each processing activity and, in particular, to specify whether processing is based on law, provided for by a contract, or necessary to enter into a contract.

Data is processed at the Data Controller’s operating premises and at any other location where the parties involved in the processing are based. For further information, please contact the Data Controller.

The User’s Personal Data may be transferred to a country different from the one in which the User is located. To obtain further information on the place of processing, the User may refer to the section on details of Personal Data processing.

The User has the right to obtain information regarding the legal basis for the transfer of Data outside the European Union or to an international organisation under public international law or established by two or more countries, such as the UN, as well as regarding the security measures adopted by the Data Controller to protect such Data.

Should any of the transfers described above take place, the User may refer to the relevant sections of this document or request information from the Data Controller by contacting the details provided at the beginning of this document.

Retention Period

Data is processed and retained for as long as required for the purposes for which it was collected.

Therefore:

Personal Data collected for purposes related to the performance of a contract between the Data Controller and the User will be retained until the performance of that contract is complete.
Personal Data collected for purposes attributable to the Data Controller’s legitimate interest will be retained until that interest is satisfied. The User may obtain further information regarding the legitimate interest pursued by the Data Controller in the relevant sections of this document or by contacting the Data Controller.

Where processing is based on the User’s consent, the Data Controller may retain Personal Data for longer until that consent is withdrawn. Furthermore, the Data Controller may be required to retain Personal Data for a longer period in compliance with a legal obligation or by order of an authority.

Upon expiry of the retention period, Personal Data will be deleted. Therefore, at the end of that period the right of access, erasure, rectification, and the right to data portability can no longer be exercised.

Purposes of Processing of Collected Data

The User’s Data is collected to allow the Data Controller to provide its Services, as well as for the following purposes: recording of training attended, invoicing, management of support and contact requests, and statistical analysis related to the quality of the service provided.

User Rights

Users may exercise certain rights with regard to the Data processed by the Data Controller.

In particular, the User has the right to:

withdraw consent at any time. The User may withdraw consent to the processing of their Personal Data previously given.
object to processing of their Data. The User may object to the processing of their Data where it is carried out on a legal basis other than consent. Further details on the right to object are set out in the section below.
access their Data. The User has the right to obtain information on the Data processed by the Data Controller, on certain aspects of the processing, and to receive a copy of the Data processed.
verify and request rectification. The User may verify the accuracy of their Data and request that it be updated or corrected.
obtain restriction of processing. Where certain conditions apply, the User may request that processing of their Data be restricted. In such case, the Data Controller will not process the Data for any purpose other than their storage.
obtain erasure or removal of their Personal Data. Where certain conditions apply, the User may request that the Data Controller erase their Data.
receive their Data or have it transferred to another controller. The User has the right to receive their Data in a structured, commonly used and machine-readable format and, where technically feasible, to have it transmitted without impediment to another controller. This provision applies where Data is processed by automated means and the processing is based on the User’s consent, on a contract to which the User is a party, or on pre-contractual measures related thereto.
lodge a complaint. The User may lodge a complaint with the competent personal data protection supervisory authority or take legal action.

Details on the Right to Object

Where Personal Data is processed in the public interest, in the exercise of official authority vested in the Data Controller, or for the purposes of the legitimate interests pursued by the Data Controller, Users have the right to object to such processing on grounds relating to their particular situation.

Users are informed that, where their Data is processed for direct marketing purposes, they may object to such processing without providing any justification. To find out whether the Data Controller processes data for direct marketing purposes, Users may refer to the relevant sections of this document.

How to Exercise Your Rights

To exercise User rights, Users may direct a request to the Data Controller’s contact details indicated in this document. Requests are submitted free of charge and are addressed by the Data Controller as promptly as possible, in any event within one month.

Additional User Rights

We never sell or rent Users’ Data to third parties for any reason. The only uses of Data are those outlined in this policy. Users are the sole owners of their Data and may request its modification or deletion at any time.

Further Information on Processing

Legal Defence

The User’s Personal Data may be used by the Data Controller in legal proceedings or in the preparatory stages thereof for the purpose of defending against misuse of the Services by the User.

The User declares to be aware that the Data Controller may be required to disclose Data upon order of public authorities.

Information Not Contained in This Policy

Further information regarding the processing of Personal Data may be requested at any time from the Data Controller using the contact details provided.

Changes to This Privacy Policy

The Data Controller reserves the right to make changes to this privacy policy at any time, informing Users by sending a notification through one of the contact details held by the Data Controller. Please therefore consult this page regularly, referring to the date of last modification indicated at the bottom.

Where changes affect processing whose legal basis is consent, the Data Controller will collect the User’s consent again, if necessary.

Definitions and Legal References

Personal Data (or Data)

Any information that, directly or indirectly, even in conjunction with any other information, including a personal identification number, renders an identified or identifiable natural person constitutes personal data.

User

The individual who uses this service who, unless otherwise specified, coincides with the Data Subject.
